Relevant Philippine Laws for Education

As an educator, it is important to be well informed of the laws. Being well informed of the law will help the teachers know their rights, responsibilities, and liabilities in an educational setting.

Here are some relevant laws that are related to education:

The 1987 Philippine Constitution

            Note: Many Filipinos refer to the 1987 Constitution as the Freedom Constitution but this is wrong. The Freedom Constitution was enacted in 1986 as a temporary constitution while the 1987 constitution was being drafted and created.

RA 7722: Higher Education Act of 1994 (CHEd)

RA 7796: TESDA Act of 1994

RA 9155: Governance of Basic Education Act

            Note: This is the law that renamed Department Education, Culture and Sports to Department of Education. 

RA 10157: The Kindergarten Education Act

RA 10533: Enhanced Basic Education Act of 2013 (K+12)

            This is one of the major legislations of the Noynoy Aquino Administration.

RA 10931: Universal Access to Quality Tertiary Education Act

            This is the law that gives free college education to the students of State Universities and Colleges and Local Universities and Colleges (SUCs and LUCs).

RA 8491: The Flag and Heraldic Code of the Philippines

            Interesting Fact: Section 14 of this law states that "A flag worn out through wear and tear shall not be thrown away. It shall be solemnly burned to avoid misuse or desecration."

RA 6713: The Code of Conduct and Ethical Standards for Public Officials and Employees

RA 7836: The Philippine Teachers Professionalization Act of 1994

            Pregnancy out of wedlock is not an immoral conduct nor a ground for termination of contract of teachers. This is based on the Supreme Court decisions in Cheryll Leus v. St. Scholastica's Colger Westgrove and/or Quiambao, Christine Capin-Cadiz v. Brent Hospital and Colleges, and Union School International v. Charley Jane Dagdag.

RA 7877: Anti Sexual Harassment Law

2010 Revised Manual of Regulations for Private Schools

RA 9184: Government Procurement Reform Act

RA 9710: Magna Carta of Women

RA 9165: Comprehensive Dangerous Drugs Act of 2002

RA 7610: Anti Child Abuse Law or Special Protection of Children Against Abuse, Exploitation and Discrimination Act

            Note: Do not say Child Abuse Law. It will sound like it is a law permitting child abuse. Use the word anti.

RA 9262: Anti-Violence Against Women and their Children Act

            Similar to RA 7610, do not call it VAWC Law because it will sound like it is a law permitting violence against women and their children. Use the word anti.

RA 3019: Anti-Graft and Corrupt Practices Act

EO 209, s 1987: Family Code of the Philippines

            It is an executive order which means it is not passed by Congress but by the President of the Philippines - Pres. Corazon Cojuangco Aquino.

RA 9995: Anti-Photo and Video Voyeurism Act

            Yes, that's right! There is a law prohibiting people to take a picture of someone without their permission. Don't take a picture of your crush secretly, crush-back will happen haha.

RA 10173: Data Privacy Act of 2012

            Do not use the word anti here.
